Terms of Service

These Terms of Service ("Terms") govern your use of BloomYard, a garden planning service operated by Courtney Greenwood d/b/a BloomYard ("BloomYard," "we," "us," or "our"), located in Massachusetts. By creating an account or using BloomYard, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

BloomYard provides tools to help you plan, track, and maintain a garden that blooms year-round. Features include plant recommendations, garden bed planning, care reminders, and a plant library. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.

2. Accounts

You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for all activity under your account. You must be at least 13 years old to use BloomYard. We may suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

Some features require a paid subscription. Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current rate. You may cancel anytime; cancellation takes effect at the end of your current billing period. We do not issue refunds for partial billing periods unless required by law.

4. Your Content

You own the content you add to BloomYard — your garden plans, notes, and data. By using the service, you grant us a limited license to store and display that content to provide the service to you. We do not sell your personal content to third parties. You can export or delete your data at any time by contacting us.

5. Acceptable Use

You agree not to:

  • Use BloomYard for any unlawful purpose
  • Attempt to access another user's account or data
  • Scrape, copy, or redistribute our plant database or recommendations
  • Reverse engineer or attempt to extract our underlying AI models or prompts
  • Interfere with the security or performance of the service

6. Plant Recommendations

Plant recommendations are generated using AI and are intended as a starting point for garden planning, not professional horticultural advice. Results may vary based on your specific microclimate, soil conditions, and local regulations. Always verify plant suitability with a local nursery or extension service before purchasing.

7. Intellectual Property

BloomYard's design, code, copy, and brand are owned by Courtney Greenwood d/b/a BloomYard and protected by copyright law. You may not reproduce, distribute, or create derivative works without our written permission. Plant photos sourced from Unsplash are used under the Unsplash License. Plant photos sourced from iNaturalist are used under their respective Creative Commons licenses.

8. Third-Party Services

BloomYard uses third-party services including Supabase (database), Stripe (payments), Anthropic (AI recommendations), and Vercel (hosting). Your use of BloomYard is also subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

9. Disclaimer of Warranties

BloomYard is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that plant recommendations will produce specific results in your garden. Use the service at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, BloomYard and Courtney Greenwood shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

You may delete your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the service ends. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Massachusetts. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of BloomYard after changes constitutes acceptance of the updated Terms.
